GuidaVista Terms of Use

These terms apply to the GuidaVista iOS app (the "app") and to the travel guides you buy in it (the "guides"). They are an agreement between you and the developer, Darius Cirjan ("the developer", "we"). By downloading, using or buying in the app you accept them.

Apple's Standard EULA

The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"). These terms add the rules that apply to the guides. If they conflict on the use of the app itself, the Standard EULA prevails. Apple is not a party to these terms and is not responsible for the app, the guides or any support for them.

Your licence to the guides

When you buy a guide edition, you receive a personal, non-exclusive, non-transferable licence to download it and read it on the Apple devices you own or control, and to print it for your own trips.

You may not:

Short quotations for personal, non-commercial use are fine. The guides, their texts, maps, illustrations and photos are protected by copyright and belong to the developer or its licensors. Buying a guide does not transfer any of these rights to you.

Information in the guides

Each guide states the date its information is valid as of. The guides are fact-checked before publication, but prices, opening hours, timetables, entry rules and local conditions change, sometimes without notice. Before you rely on any detail, especially for bookings, visas and entry requirements, health and safety, check the official sources: the attraction or venue, the transport operator, and your government's travel advice.

The guides give general travel information. They are not legal, medical, financial or safety advice. We may publish updated versions of a guide, but we are not obliged to.

Purchases

Guides are sold through Apple In-App Purchase, under Apple's terms and with Apple's payment methods. The price is the one shown in the App Store at the time of purchase, in your local currency. Each guide edition is a one-time purchase, not a subscription.

Your purchases are recorded by Apple and by RevenueCat, the service the app uses to know which guides you own, as described in the privacy policy. Use "Restore purchases" in the app to get them back after a reinstall or on another device signed in with the same Apple Account.

Refunds

Payments and refunds are handled by Apple, not by the developer. The developer cannot issue refunds and cannot see your payment details. To ask for a refund, use reportaproblem.apple.com. A refunded guide can no longer be downloaded from the app.

If you are a consumer in the European Union or the United Kingdom, your statutory rights for digital content apply in full, and Apple handles any withdrawal or refund request.

Downloads and availability

Guides you bought can be downloaded through the developer's download service, and a downloaded guide stays on your device until you delete it. We work to keep the service available, but it can be interrupted for maintenance or for reasons outside our control.

If a guide is taken off sale, buyers can still download it. The only exception is a guide that has to be withdrawn for legal reasons, for example a rights claim. We recommend keeping your downloaded guides on your device.

Fair use of the service

Do not try to get around the purchase check, download guides you did not buy, overload the download service or access it in automated ways other than through the app.

Liability

As far as the law allows, the app and the guides are provided as they are. We are not liable for losses that come from information having changed after the date stated in a guide (for example a closed attraction, a changed timetable or a different price), for missed connections or bookings, or for indirect or consequential losses. Our total liability to you for a guide is limited to the amount you paid for it.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

Governing law

These terms are governed by the law of Romania. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a claim in its courts.

Changes to these terms

We may update these terms, for example when the app gets new features. The date at the top shows the latest version. Changes do not take away rights to guides you already bought.
